KASONDE MWENDA CALLS FOR RESPECT FOR COURT ORDERS AND THE RULE OF LAW IN THE MUKANDILA CASE

Economic Freedom Fighters-EFF President Kasonde Mwenda has raised concerns over the continued detention of Tonse-Pamodzi Alliance Secretary General Celestine Mukandila.

Mr. Mwenda alleges that Mr. Mukandila was taken to the University Teaching Hospital, UTH, for a medical procedure aimed at determining his age.

He has questioned the legality and necessity of the procedure, arguing that it infringes on Mr. Mukandila’s constitutional rights.

Mr. Mwenda has also cited the 25th September 2026 High Court judgment in the matter involving Mr. Mukandila, saying the court addressed concerns surrounding his prolonged detention and the transfer of the matter between government institutions.

According to Mr. Mwenda, Mr. Mukandila has remained in detention for more than 40 days despite the court granting bail

The EFF President has consequently called on the government to respect court orders and uphold the rule of law.

Mr. Mwenda further expressed concern that continued disputes over constitutional and legal protections could affect investor confidence in the country.

The allegations made by the EFF President have not been independently verified, and the position of the relevant government authorities has not been included in the statement.

It is regrettable that UPND’s govt DPP Gilbert Phiri dragged Mr. Celestine Mukandila to UTH (University Teaching Hospital) and conducted a medical operation to determine his age 😢, this is an affront on his constitutional rights. This medical procedure is predominantly used to ascertain age of defilement victims and hence should not be abused to target political opponents for humiliation.
This has unsettled his family who feel traumatized and abused by the State.

Secondly, the High Court Judgement of 25 September 2026 has found the UPND Govt guilty of breaking the Law in the case involving the prolonged detention of Mr. Celestine Mukandila Tonse-Pamodzi Alliance SG. This is in the matter where the state  Illegally transferred Mr. Celestine Mukandila from one government body to another as it held him in perpetual detention. Bail has again been granted as the earlier one was ignored by the state, however Mr. Celestine Mukandila still remains detained for over 40 days now.

As Economic Freedom Fighters-EFF we are saddened by the continued disregard for the Courts and the Rule of Law by Mr. Hakainde Hichilema’s government. We demand for the rule of law to be respected because Zambia is a constitutional Democracy where laws govern not individuals. Zambia is unfortunately descending into an autocracy and this will cost us investments and our economy will continue falling for lack of Investor Confidence in our legal system.
