Losing Lumezi South Member of Parliament, Lufeyo Ngoma has asked the Chipata High Court to nullify the parliamentary election results or, alternatively, order a recount of the votes.

Mr Ngoma, who contested the election on the United Party for National Development (UPND) ticket, has challenged the results, alleging that the polls were marred by vote buying, intimidation, violence and other electoral malpractices.

He has also alleged discrepancies in election figures, alteration of figures and other irregularities during the electoral process.

Testifying before Chipata High Court Judge-in-Charge Justice Charles Kafunda, Mr Ngoma alleged that National Reconciliation Party for Unity and Prosperity (NRPUP) candidate Oliver Mwale who won the seat, engaged in electoral malpractices, including vote buying, violence and political intimidation.

Mr Ngoma alleged that on August 12, 2026, Mr Mwale, in the company of NRPUP polling agents, was seen distributing salt, soya pieces, ballpoint pens and K20 notes to electorates in Chibande Ward.

The court heard that Mr Ngoma subsequently decided to tour all six polling stations in the ward, but was unable to hold successful meetings because some people allegedly demanded the same items that Mr Mwale was distributing.

He testified that voters at different polling stations in Chibande Ward openly told him that Mr Mwale had informed them that the ballpoint pens were allegedly from the Electoral Commission of Zambia (ECZ) and were to be used on voting day.

Mr Ngoma told the court that the voters allegedly received the items from Mr Mwale with instructions to vote for him and Tonse Alliance presidential candidate Brian Mundubile.

He added that people would disperse before meetings could commence because he did not have the items which his opponent was allegedly distributing.

“My Lord, I got deeply concerned with this situation because the people were refusing to start the meetings because I did not come with salt, soya pieces, ballpoint pens and K20, which Mr Oliver Mwale would come with,” he said.

Mr Ngoma further told the court that after casting his ballot at Kakulo Polling Station in Lukusuzi Ward on August 13, 2026, he saw Mr Mwale, in the company of Evans Manda, an NRPUP polling agent, allegedly distributing ballpoint pens and K20 notes to voters in the queue and instructing them to vote for him and Mr Mundubile.

Mr Ngoma said he felt helpless over what he described as the level of electoral malpractices, adding that there was no Police Officer at the polling station and that a village scout had instead been deployed to assist with security.

He testified that he later visited Lukusuzi Polling Station, where he allegedly found NRPUP polling agents Evans Manda and Matthews Kashimu distributing money and other materials within the polling station’s perimeter while chanting party songs and displaying NRPUP symbols.

Mr Ngoma said his efforts to seek police intervention failed because the village scout deployed to the polling station was allegedly intimidated by a large crowd supporting the opposition.

He further told the court that on voting day, he visited Kamukwezi Polling Station in Kachama Ward but was allegedly blocked by NRPUP polling agent John Lungu, whom he found allegedly distributing ballpoint pens and K20 notes to voters standing in the queue.

Mr Ngoma said he then proceeded to Mwimba Polling Station, where he found two vehicles surrounded by a large crowd about 10 metres from the polling station.

He told the court that as he approached the crowd, he allegedly saw Mr Mwale in the company of NRPUP candidate for council chairperson Dawson Tembo and other unidentified people distributing K20 notes and ballpoint pens to voters.

“I further received calls from my polling agents from Katube Polling Station, Kangobe Polling Station, Masutwe Polling Station and Ndundundu Polling Station. The situation was almost the same my lord, there was also vote buying, violence and intimidation,” he said.

The court also heard that when Mr Ngoma visited Mpingozi Polling Station in Diwa Ward, he was informed by a UPND polling agent that Mr Mwale had allegedly slaughtered a cow on August 12, 2026 and was feeding voters at a house belonging to an NRPUP polling agent near the polling station.

Mr Ngoma further alleged that Lusaka Diocese Archbishop Alick Banda distributed K50 notes, sausages and ballpoint pens to nearly 400 people at a farm in Lumezi South while allegedly instructing them to vote for Mr Mundubile and Mr Mwale.

He alleged that Archbishop Banda, in the company of Mr Mwale and his polling agent Nicholas Nkhoma, distributed the materials in Lumezi South for three consecutive days, a week before the general election.

During cross-examination by Timothy Sapato of Nkonde and Kapingula Associates, the petitioner told the court that there are no videos or pictures from Dr. Alick Banda’s farm, other than a witness who is yet to give their testimony.

Mr Ngoma’s petition comes after Oliver Mwale was declared duly elected Member of Parliament for Lumezi South after he polled 6,324 votes during  the August 13, General Elections beating Mr Ngoma who got 4,946 votes.
