Zambia : Kabwe Magistrate Adjourns Defilement Case

Kabwe Resident Magistrate, Sebastian Mwenya adjourned the matter after the accused, Levy Tebulo concluded his defense to allow the arresting officer, who was not present before the court, to come and cross-examine Tebulo in the next session.
In this matter, Tebulo stands charged with defilement contrary to Section 138 of the Penal Code Chapter 87 as amended with Act Number 15 of 2005 and Act Number 2 of 2011 of the Laws of Zambia.
When the matter came up for defense trial, Tebulo maintained his innocence by denying the allegations.
He told the court that on the material day, he had just come back from work and was preparing to cook his meal when a team from the neighborhood watch apprehended him on allegations that he had defiled a minor.
He further said he suspected his brother-in-law could have framed him over some land dispute issues they have been trying to settle as a family.
“Your honor, the father of the girl in question is my brother-in-law. He had approached me to give him part of our family piece of land, and when I refused, this did not sit well with him whereby at some point, an argument ensued where he told me that he would find a way of punishing me,” Tebulo submitted.
Brief facts before the court are that, Levy Tebulo between February 3, 2026 and February 14, 2026 in Kabwe District had unlawful carnal knowledge of a girl child under the age of 16 years.
The court has since adjourned the matter to October 5, 2026 for the continuation of trial as Tebulo remains in police custody.
The matter is being prosecuted by Senior State Counsel, Veronica Chikoyi of the National Prosecutions Authority (NPA).
