A 35-year-old man has been sentenced to 28 months’ imprisonment with hard labour for trafficking in 2.1 Kilograms of marijuana by the Chisamba Magistrate Court.

Gift Phiri of Ten Miles area has been convicted and sentenced by Chisamba Magistrate, Litungi Litungi upon his own plea of guilty and admission of facts.

Phiri was facing one count of trafficking in psychotropic substances, contrary to Section 15 of the Narcotic Drugs and Psychotropic Substances Act Number 35 of 2021 and Statutory Instrument Number 119 of 1995.

Particulars of the offence are that on September 7, 2026, Phiri trafficked in 2.1 kilograms of marijuana without lawful authority.

The court heard that, in an intelligence-led operation, Drug Enforcement Commission (DEC) officers found Phiri in possession of two pre-packed quantities of the drugs concealed in a black bucket at Ten Miles.

“On 7th September, 2026, a team of four officers from the Drug Enforcement Commission led by Isaac Nkhuwa conducted a patrol at 10 miles area after receiving intelligence information of a man dealing in Marijuana in the area,” the facts read in part.

The court further heard that samples of the drug were seized and sent to the University Teaching Hospital Food and Drug Control Laboratory in Lusaka, where analysts confirmed that the substance was cannabis sativa, with a Delta-9-tetrahydrocannabinol, or THC, content of 4.7 percent, exceeding the legal limit of 0.3 percent.

Following a warn-and-caution statement conducted in Nyanja by DEC Investigation Officer Nancy Banda, Phiri confessed to the offence while in Police custody.

In mitigation, Phiri pleaded for leniency, saying he has two school-going children who look up to him and that he also takes care of his mother, who is diabetic.

In passing sentence, Magistrate Litungi stated that drug abuse has destroyed many youths and that it was the duty of the court to impose stiffer punishment on offenders to deter would-be offenders.

“The punishment for the offence which you committed is imprisonment for a term of not less than one year, but not exceeding 25-years.

“However, I have taken recognition that the convict is a first offender who has readily admitted the charge and taken into consideration his mitigating factors,” Magistrate Litungi said.

He then sentenced Phiri to 28 months’ imprisonment with hard labour, effective September 28, 2026.

The court further ordered that the drug be forfeited to the State and destroyed by burning in the presence of court officials.
