Findlay’s Health Deteriorating In Detention, Family Says

The family of detained Lusaka businessman Harry Valden Findlay says his health has deteriorated sharply after he was denied access to his prescription medication, with the 63-year-old now on a drip and his whereabouts unknown to relatives for extended periods during his detention. The family has emphasized the urgent need for medical attention for Findlay.

In a statement issued at the weekend, the family said it remained deeply concerned that the State had continued moving Findlay between different detention facilities without informing them, leaving them without knowledge of his location for 12 days at a stretch. They called for immediate action to ensure Findlay receives the care he urgently needs.

“We have waited… we have pleaded for humane treatment… we have asked that the law be followed despite the gravity of the charges, to no avail,” the family said.

The statement described a pattern of repeated transfers that left relatives struggling to track Findlay’s condition. “But we are afraid, Harry keeps getting moved between facilities, for 12 days we did not know his whereabouts, he was denied access to his prescription medication and now he is unwell,” the family said.

According to the statement, Findlay has been on a drip since Wednesday, September 2, but has not been taken to hospital despite the seriousness of his condition. The family said the State was fully aware of his medical history and appealed for that awareness to translate into action.

“He needs specialised medical treatment. The State is aware of his medical condition! Regardless of the charges, every human being has constitutional rights! We are seeing someone we love become weaker day by day!” the family said.

The family stressed that detention should never be allowed to become a form of punishment in itself, insisting that Findlay’s wellbeing could not be treated as secondary to the legal process against him. “His life matters, his health matters! We plead that Harry is treated humanely!” the statement read.

Efforts to have Findlay brought before a court to address the concerns around his detention have similarly stalled. The family said it had applied for a writ of habeas corpus seeking to have him produced before the court, but the process was repeatedly delayed because the State failed to bring him to the scheduled hearings.

After several adjournments linked to Findlay’s continued absence, the court proceeded to hear the application without him present, a development the family said undermined the very purpose of the habeas corpus process, which exists to establish the lawfulness of a person’s detention through direct judicial scrutiny.

“Harry has rights! We appeal that these rights are afforded to him!” the family said, framing their appeal as one rooted in constitutional principle rather than a dispute over the underlying allegations against him.

The family was careful to separate the question of guilt or innocence from the question of humane treatment, stating plainly that whatever the outcome of the case against Findlay, no set of allegations could justify the permanent loss of his life or health while the matter remained before the courts.

“Whatever the allegations against Harry, his life cannot be restored if it is lost!” the family said, closing their statement with a direct appeal for the authorities to act before his condition worsens further.

As of the time of the family’s statement, Findlay had not been transferred to hospital despite being on a drip for several days, and his exact custodial location was not confirmed publicly. The family said they intended to continue pressing for both his medical treatment and his right to appear before a court to challenge the legality of his continued detention.

The case adds to a wider pattern of concern raised by rights groups and opposition figures in recent weeks over the treatment and welfare of individuals held in custody following the disputed August general election period, with families of several detainees separately calling for greater transparency around detention conditions and access to medical care.
