The Act shall be called, Benefits of Former Presidents and Former Vice-Presidents Act No.16 of 2026. Date of Assent 4th June, 2026.

Government repeal and replace the Benefits of Former Presidents Act 1993; and provide for matters connected with, or incidental to, the following.

Interesting to note is that the Act provides that government of the Republic of Zambia shall decide where a former President or sitting head of State who dies shall be buried by the government. It also provides for Benefits of a former Vice President and the said must not be in active politics!

This Act came to remedy the lacuna (gap) in the Benefits of Former Presidents Act of 1993 which provided that a former President is stripped off his/her retirement Benefits if he/she remained active in politics and could be buried anywhere by his family if he/she died stripped off his/her retirement Benefits by the government of the Republic of Zambia.
