High Court Throws Out Hon. Iris Kaingu’s Application

The high court seating in MONGU has thrown out an application made by Honourable Iris Kaingu to dismiss the petition filed by Honourable SIBESO Sefulo challenging her election.

Hon Kaingu through her lawyers Malisa & partners applied to the high court to have the petition dismissed on grounds that she was not personally served.

In opposing the application Mulenga Mwango of MAK PARTNERS representing Hon. Sefulo argued that Hon Kaingu was being elusive and that this posed difficulties to serve her personally. That because of these difficulties they applied that she be served by substituted service which was granted by the court.

However Hon Kaingu informed court through her lawyers that service could  be done through the same lawyers but later applied to court to have the matter dismissed on what she deemed as improper service.

The high court in dismissing the application held that there was proper service because the lawyers confirmed that they had instructions to receive court documents on her behalf.
