Zambia : Yuyi, Six Co‑accused Granted K200,000 Bail Each

The Mufulira Magistrate’s Court has granted K200,000 bail each to former Copperbelt Commissioner of Police Mwala Yuyi and six co-accused facing charges of fraudulently dealing with metals.

The bail was granted by Ndola Principal Resident Magistrate Samson Mumba, who sat at the Mufulira Magistrate’s Court to preside over the matter.

The seven defendants stand accused of violating Section 289 of the Penal Code, Chapter 87 of the Laws of Zambia.

Charged alongside Mr.Yuyi, 57, are three police officers namely, Allan Mukale, 51, Patrick Mutti, 55, and Borniface Nchimunya, 57.

The co-accused also include Magistrate Edward Banda, 53, Clerk of Court O’Brien Chipunza, 44, and businessman Daniel Makina, 42.

All seven accused pleaded not guilty to the charge when it was read to them.

Particulars of the offence allege that between March 10 and March 23, 2026, the seven accused persons, acting together, fraudulently took, concealed, and disposed of 436 copper cathodes valued at approximately 448,596 United States dollars, with intent to defraud Zero Degree Investment Limited.

The group, represented by a defense team drawn from seven law firms, was arrested on July 29, 2026.

Applying for bail, defense attorney Cassandra Chakanika from Kabesha and Company Legal Practitioners informed the court that the accused had spent over 35 days in police custody without appearing in court.

Ms Chakanika argued that the offence of fraudulently dealing with metals is bailable under Section 123, sub-section 1 of the Criminal Procedure Code, Chapter 88 of the Laws of Zambia.

“Six of them are civil servants and one is a businessman who are not a flight risk, and they should be granted bail as they have ready sureties who will ensure that they appear before court,” Ms Chakanika submitted.

State Prosecutor Phillip Ludaka raised no objection to the application for bail, but prayed that the accused be ordered not to interfere with state witnesses.

In his ruling, Magistrate Mumba granted the accused bail in the sum of K200,000 with two working sureties from reputable institutions for each defendant.

He strictly ordered the accused not to tamper with state witnesses and warned that any breach of the bail conditions would lead to immediate revocation.

Speaking to the media after the court session, defense lawyer Siisii Mulele welcomed the court’s decision to grant bail, describing it as the beginning of the road to justice for their clients.

The matter has been adjourned to October 1, 2026, for mention and fixing of trial dates.
