Zambia : Njobvu Says Judiciary Dented Its Reputation By Closing Courts After The Election

Democratic Union leader Ackim Njobvu has said the Judiciary dented its own reputation when it closed courts after the disputed general election, and that it will be difficult for the institution to erase the effect on citizens’ access to justice.

Mr Njobvu said the damage was greatest at a time when people needed the courts most, particularly during the election. In an interview, he said the Judiciary must now work harder to restore public confidence and ensure citizens can exercise their constitutional rights.

He questioned whether denying citizens access to the courts was consistent with the responsibility to uphold justice.

“When you are closing courts, when you are denying people justice, when people needed to petition you close the courts. People lost trust and confidence in such institutions,” Mr Njobvu said.

The Judiciary, he said, should take steps to restore its reputation and prevent citizens from losing confidence in the country’s justice system. He addressed it directly.

“You have to respond to this. You have to redeem yourselves. You have dented your reputation as a Judiciary. Zambians have no respect and trust in this dented Judiciary,” he said.

Mr Njobvu also pointed to major judicial decisions on the eligibility of the late former president Edgar Lungu and on constitutional amendments. The Judiciary’s handling of such matters, he said, should be examined against its previous decisions.

He said citizens should be allowed to exercise their constitutional rights, including access to the courts, and closed with an appeal.

“What I would love to appeal is that where we are right now, let’s accord citizens the opportunity to access the courts. Let’s accord citizens the opportunity to exercise their rights,” Mr Njobvu said.

He then turned to the losing candidates of the United Party for National Development (UPND). Mr Njobvu questioned their decision to challenge the results of the polls after the ruling party had described the elections as free and fair.
