The Tonse-Pamodzi Alliance announced the date in a statement signed by Acting Secretary General Muhabi Lungu. The petition, filed against the State by the detainees’ lawyers, also covers 16 other detainees.
It cites gross violations of constitutional rights through lengthy detention without the detainees being brought before a court to plead and stand trial.
The alliance said the matter concerns treason charges and the detainees’ incarceration at Mukobeko Maximum Prison, about 150 kilometres north of Lusaka.
Mr Lungu said Mr Mundubile, a leading opposition figure, and Mr Zulu have been “illegally detained without a day in court for 42 days”. The statement said three High Court judges will hear the case.
Churches and bishops have raised the treatment of arrested persons in recent days. On Wednesday, the Council of Churches in Zambia called for arrested persons to be treated humanely, informed of the allegations against them and brought before competent courts in accordance with the law.
The church leaders said no one is above the law, and no person should be denied its protection.
The Catholic bishops raised similar concerns in a pastoral letter dated September 30, expressing concern about alleged arbitrary arrests and detentions.
State House has rejected the idea that lawful arrests amount to persecution. Chief Communications Specialist Mr Clayson Hamasaka said an arrest “establishes neither guilt nor persecution, irrespective of the accused person’s political or religious standing”.
He added that allegations of unlawful detention or abuse should be investigated individually, and that lawful arrests should not be characterised as abductions.
Economic Freedom Fighters president Mr Kasonde Mwenda said Mr Mundubile and Mr Zulu “remain caged in Maximum Prison on trumped up charges”.
For the detainees, the next step is October 26, when the three judges take up the petition.
