The Zambia Land Alliance (ZLA) has revealed that according to the Fencing Act a neighbor who fails to pay for a fence but agrees to pay late is obliged to add an interest of six percent.

 Speaking in an interview with the Zambian Business over the rampant wrangles that ensue from fencing, ZLA Executive Director Patrick Musole said there is a deep lack of awareness of the fencing law; as a result, disputes keep on increasing.

 He called on homeowners to agree on the type of fence and other monetary conditionality in a bid to avert disputes.

 “There is a need to agree on the type of fence so that one does not impose the other costs that the neighbor is unwilling to pay; there are supposed to be discussions, and once they agree, then they contribute, but if they are not willing to contribute, they will have to pay later and add an interest of 6 percent that should be charged,” he added.

 Musole emphasized that the cost of fencing should be shared equally and proportionately amongst the neighbors. Stakeholders have vigorously been calling for the amendment of the fencing act, arguing that in its current form it does not address modern real estate, customary land disputes, and conflict among neighbors.
