Three of Zambia’s recognised Paramount Chiefs have opposed an application seeking the recognition of Chief Mukuni as a Paramount Chief and have asked the court to allow them to join the case.

Paramount Chief Chitimukulu of the Bemba people, the Litunga of the Lozi people and Kalonga Gawa Undi of the Chewa people say they have a direct interest in the matter because its outcome could affect Zambia’s traditional leadership system.

The application relates to a case involving Jonas Shakafuswa and Attorney General Mulilo Kabesha.

Zambia currently has four recognised Paramount Chiefs: Chitimukulu of the Bemba people, the Litunga of the Lozi people, Kalonga Gawa Undi of the Chewa people and Paramount Chief Mpezeni of the Ngoni people.

The three traditional leaders argue that the creation or recognition of another Paramount Chief is an issue of national importance with the potential to affect long-established customary leadership systems.

They have asked the court to allow them to participate in the proceedings so they can present their concerns before a decision is made.

In his affidavit, Paramount Chief Chitimukulu said recognising another Paramount Chief could encourage junior chiefs across the country to challenge existing traditional authorities.

He said his chiefdom covers several districts, including Mungwi, Kasama, Mporokoso, Luwingu, Chinsali and Mpika, where numerous senior chiefs, chiefs, deputy chiefs and headmen owe allegiance to his authority.

Paramount Chief Chitimukulu said the matter has the potential to weaken traditional leadership structures and destabilise the chieftainship.

He further stated that Chief Mukuni is one of more than 40 chiefs in Southern Province and that the recognition of another Paramount Chief requires careful consideration because of its potential impact on the country’s traditional governance system.

The Litunga has also applied to join the proceedings, arguing that the matter affects all Paramount Chiefs and the preservation of Zambia’s traditional institutions. He said the outcome could set a precedent on how Paramount Chiefs are created or recognised in future.

Kalonga Gawa Undi Mkhomo V has also asked to be joined to the proceedings. In his affidavit, he said he was selected and installed by the Undi Royal Family in 2004 as the 27th Gawa Undi and that his traditional authority extends over Chewa communities in Zambia, Malawi and Mozambique.

He said the matter extends beyond one individual chief and could have implications for traditional leadership systems across Zambia.

The three Paramount Chiefs told the court that their participation would assist in ensuring all relevant views are considered before a determination is made. They are seeking to be joined as parties before the court rules on the petition.
