Zambia : Court Grants Mukandila Habeas Corpus, Orders State To Justify Detention

The Lusaka High Court has granted Tonse/Pamodzi Alliance Secretary General Celestin Mukandila leave to issue a Writ of Habeas Corpus, compelling the State to bring him before the court and explain the basis for his continued detention.

Mukandila was arrested on August 20 and charged with concealing his true national identity and unlawful possession of a National Registration Card. He has denied the allegations and is seeking his immediate release, arguing he has been detained since his arrest without being taken before a court or granted police bond.

According to court documents, the Department of Immigration opposed Mukandila’s application for habeas corpus, citing that he had not produced credible sureties to facilitate his release on police bond.

Principal Immigration Officer Ian Mutamina told the court that Mukandila was arrested on August 20, 2026 and charged with concealing his true national identity and unlawful possession of a National Registration Card. He said all required procedures had been followed and that a docket had been submitted to the National Prosecution Authority on September 2 to facilitate Mukandila’s court appearance.

The State’s application to further delay Mukandila’s court appearance was declined, with the judge ordering that the applicant be brought before the court to allow the matter of his continued detention to be tested judicially.

Mukandila’s legal team argued that his continued detention without a court appearance was unconstitutional, and that the delay in processing his docket had exceeded what was reasonably justifiable under Zambian law.

The case forms part of a broader pattern of legal challenges emerging from Zambia’s post-election period, in which several individuals connected to opposition parties have sought habeas corpus relief after prolonged periods in custody without formal court appearances.

Mukandila’s case has drawn attention in part because of his position within the Tonse/Pamodzi Alliance, a grouping that has featured prominently in the broader political tensions following the August 13 general elections.

The State maintains that its officers followed proper procedure throughout the arrest and subsequent investigation, and that the delay in bringing Mukandila before the court reflected ordinary processing timelines rather than any deliberate attempt to circumvent his constitutional rights.

Immigration officials said the docket had been forwarded to the National Prosecution Authority in early September, and that the matter would now proceed through the normal court process following the judge’s order.

The Human Rights Commission has separately raised broader concerns about the treatment of detainees connected to the post-election period, calling for prompt disposal of cases involving prolonged detention, particularly for persons arrested in connection with the August general elections.

Legal observers say the outcome of Mukandila’s habeas corpus application could have implications for how similar cases are handled going forward, particularly where questions arise over the timeliness of docket processing and the availability of bail.

The matter remains before the Lusaka High Court, with Mukandila expected to appear as directed following the judge’s ruling.
