His wife, Dinis Ng’andu, has filed an application in the Lusaka High Court seeking leave to commence habeas corpus proceedings over his continued detention without being brought to court.
In the documents, Ms. Ng’andu states that her husband remains in custody without having appeared before a court of competent jurisdiction.
She describes the matter as “one of the utmost urgency” and is seeking permission to file during the current Michaelmas vacation.
“The intended application is a matter of the utmost urgency, the same concerning the continued deprivation of the applicant’s liberty and his continued detention without, to the best of my knowledge, having been brought before a court of competent jurisdiction,” she stated.
Ms. Ng’andu further submitted that any further delay could prejudice Mr. Kafwaya and undermine the protection of his liberty.
