In a statement issued, LAZ President Arnold Kaluba said the association noted “with grave concern” the circumstances surrounding Kafwaya’s death and the subsequent arrest and detention of several people during a security operation in the election period.
LAZ said it was concerned by delays in confirming what happened and by “apparent inconsistencies” between information that emerged and earlier statements by senior government officials, including Permanent Secretaries from Defence, Home Affairs, and Information and Media at Maina Soko Medical Centre.
“These circumstances raise serious questions which cannot be left to speculation,” Kaluba said. “The circumstances surrounding the death of Hon. Kafwaya must be established through an independent, transparent, impartial and credible investigation.”
Citing Article 12 of the Constitution, LAZ said the right to life can only be limited where use of force is reasonably justifiable. “Whether the force used in this particular instance was lawful is a matter that must be objectively established,” the statement said.
LAZ also raised concern over reported arrests and prolonged detentions, citing Articles 13 and 18 on personal liberty and due process. It called on law enforcement to ensure detainees have access to lawyers, are brought to court without delay, and are not subjected to torture.
The association further urged government to cooperate with the Human Rights Commission and other oversight bodies, and demanded that all state agencies involved account for anyone arrested, injured or in custody.
“National security cannot be invoked as a blanket justification for unlawful conduct, excessive use of force, arbitrary arrest, prolonged detention or the denial of constitutional rights,” Kaluba said.
LAZ extended condolences to Kafwaya’s family and said it would continue to monitor developments.
